Bankruptcy Litigation

Ancillary litigation is common in bankruptcy cases.  Creditors are routinely sued to return pre-bankruptcy payments that were “preferential.”  Sometimes, lawsuits may be filed to set aside transfers claimed to be fraudulent conveyances, or to avoid liens, or by reason of claims of violations of federal or state laws.  Sometimes, creditors seek to enforce pre-bankruptcy contracts.  Adversary proceedings, receivership and trustee matters, and complex commercial issues are among areas where we have brought expertise in resolving difficult matters.
