In 2005, our client, a foster parent for DES, was charged with assaulting one of his residents after being provoked.  We learned that DES had incorrectly assigned the youth to our client’s care; his mental health status and discipline record mandated a more structured setting than foster care.  When the state threatened to file aggravated assault charges against our client, we contacted the prosecutor right away and pointed out the erroneous placement by DES.  We persuaded the prosecution to quietly dismiss the charges in exchange for a nominal amount of group counseling.
